An SR22 Insurance policy is required in Alaska for individuals that need to get their driving privileges (license) reinstated after a suspension or revocation. In Alaska if you are required to show proof of a SR22 Insurance policy filing before your driver’s license is to be reinstated, you must get a copy of the SR22 Insurance “binder” or an application for the “binder”, before your license can be reinstated.

For most offenses in Alaska that require a SR22 Insurance policy, you will be required to carry this kind of insurance for three (3) years from when the revocation or suspension period ends.

A few exceptions to the three (3) year rule are:

  • For a first time offense of a DWI or a refusal conviction, a SR22 Insurance policy will be required for five (5) years from when the revocation or suspension period has ended.

  • For a second offense of DWI or refusal conviction, you will be required to carry SR22 Insurance for ten (10) years from the ending date of the suspension or revocation period.

  • On a third offense of DWI or refusal conviction, you will be required to carry SR22 Insurance for twenty (20) years from the ending date of the suspension or revocation period.

  • On the fourth offense of DWI or a refusal conviction (AS 28.20.230) or an Unsatisfied Judgment (AS 28.20.230), you will be required by Alaskan law to carry SR22 Insurance for the rest of your driving life.

When you are arrested for a DUI in Alaska you will face two different actions: criminal prosecution and administrative license action.

Your driving privilege (license) can or will be revoked or suspended for the following arrests, but are not limited to only these crimes.

  • A breath alcohol test that produces a .08% BAC or greater. (non-commercial)

  • A breath alcohol test that produces a .04% BAC or greater while operating a commercial vehicle

  • If you decide to refuse to submit to a breath, blood, or urine test at the time of the police stop or later at the police station. (The purpose of these tests are used to determine an individuals alcohol content or for the presence of controlled substance(s).)

Some of the penalties associated with a DUI or with a refusal to comply with a chemical test include, but are not limited to:

  • Jail time

  • Fines

  • Referral to Alcohol Treatment and Rehabilitation Program (ASAP program)

  • License revocation or suspension (disqualification)

According to Alaska.gov, the court must revoke or suspend your driving privileges for at least the minimum period required by law. The court also has the right to extend the suspension or revocation period longer than the minimum time the law allows; this extended period has a lot to do with your driving record history.

The minimum revocation periods are:

  • 90 days for a first offense

  • 1 year if you have one prior conviction of DUI or refusal

  • 3 years if you have two prior convictions of DUI or refusal

  • 5 years if you have three or more prior convictions of DUI or refusal

If you are a commercial motor vehicle operator the court can revoke or disqualify your commercial driving privileges for the minimum period required by law. This disqualification period can be anywhere from 1 year up to life, which depends greatly on the harshness of the offense committed and your driving history.

The court's revocation or suspension period may be in conjunction with or after the Administrative revocation period. Meaning, where Alaska has two different actions that can be taken against you, criminal and administrative, the revocation or suspension periods can and may be served at the same time reducing your overall time without your driver’s license. On the other hand if you have to serve the revocation or suspension periods one after the other, this could double the time you will be without your driver’s license.

Alaska Administrative Hearing Information

First you will need to file a request for an administrative hearing by filling out this form and sending it to the DMV office near you.

In Alaska the purpose of an administrative hearing is for you to take issue with the DMV’s cancellation, revocation, or suspension of your driver’s license and try to get your driving privileges reinstated. Some of the main reasons for the cancellation, revocation, or suspension of your driving privileges are:

  • Whether or not the officer had sufficient probable cause to arrest you for driving under the influence.

  • If law enforcement had probable cause to suspect that you were involved in an accident, and that accident resulted in a serious injury to another driver or if the accident resulted in a fatality.

  • If you refused to submit to a chemical breath-test at the time of the police stop.

  • If your chemical test produced a result that confirms that you were under the influence of 1 or more controlled substances or if you BAC percentage was .08 or higher.

  • If your chemical test results produced a BAC percentage of .04 or higher or your test results reveal that you were under the influence of 1 or more controlled substances while driving or operating a commercial motor vehicle.

This is by all means not a complete list; there may be other issues that you can present a rebuttal against in your administrative hearing. Additionally, the hearing officer cannot reverse its decision to overturn a cancellation, revocation, or suspension simply because you need a driver license to get to a social event, or to work.

What will happen at an administrative hearing?

The administrative hearing officer will start by explaining the administrative hearing process, and ask if there are any questions before the hearing begins. Next the hearing officer will swear in the arresting officer, review the evidence that is being presented against you from the officer, and begin taking testimony from the arresting officer.

The administrative hearing officer needs to determine if the arresting officer established probable cause to arrest you and that the arresting officer followed proper police procedures during the arrest. Once completed the hearing officer will swear you and your attorney in, if you hired one, and any witnesses that were subpoenaed prior to the administrative hearing. The hearing officer will review the evidence that you and your attorney are presenting in your favor and will begin to take testimony from you, your attorney, and your witnesses.

Once completed the hearing officer will close the hearing and review all the evidence, from both sides and make a judgment on whether or not to uphold the cancellation, revocation, or suspension, or to reinstate your driving privileges.

After the hearing officer makes their decision the documentation will be mailed to you and your attorney (if applicable) and if the hearing officer rules in your favor your driving privileges will not be effected, but if the ruling is against you, the cancellation, revocation, or suspension will go into effect for the minimum period of time allowed by law based on your driving record and the before mentioned criteria as well.

Alaska License Reinstatement after a DUI, Breath Test, or a Breath Test Refusal

After the criminal and/or administrative suspension periods have expired it is time to get your driving privileges reinstated. One of the first steps is to apply for a new license a one of Alaska’s Division of Motor Vehicle offices and you may also need to meet the following requirements.

  • You will need to pass a written test, a vision test, and some will need to pass a road test.

  • Be required to pay the appropriate fee relating to your offense(s).

  • You will need to present written proof that you have aSR22 Insurance policy. This documentation will need to be picked up by you from the issuing insurance provider.

  • You will need to show acceptable documents of your proof of birth and your identity.

  • If you are under 18 and your parent(s) will not be coming with you to the DMV, you will need this form to be completed prior to you arriving at the DMV to get your license reinstated.

  • If you are convicted in court and are required to complete a local ASAP Program (Alcohol Safety Action Program) you can start here by finding where a facility that offers the ASAP program is located.

  • You may need proof that an ignition interlock has been installed.
