In Colorado there are many offenses that will require you to carry an SR22 insurance policy for the minimum period of three years after a conviction. These offenses vary widely from an administrative insurance suspension up to vehicular homicide.

Some of these offenses come with a license revocation or suspension of 1-year and up, while other offenses may include a jail sentence depending on the severity of the crime. As with any offense you must first serve out any revocation or suspension period and/or any jail sentence before you can begin the process of reinstating your license.

To start with we want to outline the driver’s license reinstatement procedures for some of the major offenses in Colorado, this is by no means a complete list. Administration Insurance Suspension

This suspension takes place when a police officer stops a driver and the driver is not able to produce a verifiable document that states the driver has insurance. The officer will issue the driver an Affidavit and Notice of Suspension, which is valid for 7 days. The driver will need to request a DMV hearing within 7 days of being issued a Notice of Suspension and bring proof of current insurance with them to the hearing.

If the driver can prove that they had insurance at the time of the police stop, the suspension can be avoided. If proof of insurance cannot be verified at the time of the police stop, please read the following license reinstatement requirements.

  • Completely fill out an application for reinstatement, form (DR2870), and submit it to the DMV

  • Pay the $95 reinstatement fee

  • You may be required to maintain an SR22 insurance policy for three years

  • You may have to purchase a duplicate license for $7.50 to $14, depending on if this is the first offense, second or subsequent offense

Vehicular Homicide or Vehicular Assault

After a conviction in court for vehicular homicide, vehicular assault, or criminally negligent homicide; a driver will need to serve any license suspension/cancellation/revocation periods and/or a jail sentence before that driver can begin the steps necessary to reinstate their driving privileges.

License reinstatement requirements are, but not limited to:

  • A Hearing will be scheduled to determine if your driving privileges are eligible for reinstatement

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

  • Pay the $95.00 reinstatement fee (check/money order payable to the Department of Revenue)

  • You may be required to carry a SR22 for 3 years from the date of reinstatement

  • You may be required to take an eye, written, and driving test to have a new license issued to you

Failure to Stop and Render Aid in Colorado

This action is taken against a driver if they have been convicted in court of failing to stop and render aid at an accident that resulted in an injury or death.

The license reinstatement requirements are, but not limited to:

  • A Hearing will be scheduled to determine if your driving privileges are eligible for reinstatement

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

No Liability Insurance in Colorado

An action such as this results from when the DMV receives a notice of conviction from the court of No Liability Insurance. If, before the action date a SR22 insurance policy is received by the DMV, then no action will be taken against the driver. But if action has been taken against you, here are the license reinstatement requirements:

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

  • Pay the $95.00 reinstatement fee (check/money order payable to the Department of Revenue)

  • You may be required to carry a SR22 for 3 years from the date of reinstatement

There is a license revocation order for 1-year following a conviction. Once that period has expired as well as any others the driver can begin the process of getting their license reinstated.   • You may be required to carry a SR22 for 3 years from the date of reinstatement

Any Driver Under 21 with (1) one Conviction for Alcohol/Drug use while Driving

If any driver under the age of 21 is convicted of an alcohol or drug related offense, there is a 1-year license revocation. Once that period has been satisfied and any other actions taken against the driver, the driver can start the process of getting their driver's license reinstated.

License reinstatement requirements are, but not limited to:

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

  • Pay the $95.00 reinstatement fee (check/money order payable to the Department of Revenue)

  • You may be required to carry a SR22 for 1 year unless you were involved in an accident then you will be required to carry a SR22 policy for three years

  • You may be required to complete a Level 1 Alcohol Education Course

  • You may be required to take an eye, written, and driving test to have a new license issued to you

1st Offense Chemical Test Refusal

A license revocation period of 1-year occurs when a driver refuses a chemical test for either drugs or alcohol. Additionally the driver cited for this offense has 7 days to request an administrative hearing.

License reinstatement requirements are, but not limited to:

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

  • Pay the $95.00 reinstatement fee (check/money order payable to the Department of Revenue)

  • You may be required to carry a SR22 policy for 1-year from date of reinstatement, if there were no other alcohol convictions, revocations, and no accident was involved

  • You may be required to carry a SR22 policy for 3- years from date of reinstatement if there are prior alcohol violations or if there was an accident

  • Drug and Alcohol treatment Certification (DR2598) form completed and submitted, if you were required to attend an Alcohol and Drug Treatment Center

  • You may be required to take an eye, written, and driving test to have a new license issued to you

2nd Offense Chemical Test Refusal

A driver that has been cited for this offense has 7 days to request an administrative hearing.

A license revocation period of 2-years will be imposed when a driver refuses a chemical test for either drugs or alcohol for a second time. The driver may be eligible for a restricted license with the installation of an Ignition Interlock Device (IID) for the time remaining of the total restraint period or 1-year, whichever happens to be longer.

License reinstatement requirements are, but not limited to:

  • Complete the Application for Reinstatement (DR2870) form and submit the form to the DMV

  • Pay the $95.00 reinstatement fee (check/money order payable to the Department of Revenue)

  • You may be required to carry a SR22 for 3 years from the date of reinstatement

  • Drug and Alcohol Treatment Certification (DR2598) form completed, if you were required to attend an Alcohol and Drug Treatment Center.

  • You may be required to take an eye, written, and driving test to have a new license issued to you

In addition to the above requirements, you may be instructed to provide a Certificate of installation of an Ignition Interlock Device and a signed lease agreement on all of the motor vehicles you may drive. Once the DMV has received and processed your application, they will mail a ‘Letter of Clearance’ to the address you provided on the application.

How long do I have to schedule an Administrative Hearing?

In Colorado you have 7 days to request a hearing once you have been issued a Notice of Revocation by a police officer. If at the time of the police stop your license was not surrendered, you will need to surrender it to receive a temporary driving permit.

What happens at an Administrative Hearing?

At the administrative hearing you will have the opportunity to present any evidence and/or witnesses* you have in your favor to rebut the evidence the arresting officer has against you. Once both sides have presented their evidence, the hearing officer will close the hearing and make a final decision on whether to suspend/revoke your driving privileges or dismiss the suspension/revocation and reinstate you license.

*Witnesses will need to be subpoenaed before the administrative hearing process begins. Ask your attorney, if you hired one, if there are any questions about this process.

What if I am required to take an Alcohol and Drug Treatment Course?

Sometimes the court may require drivers to complete Alcohol Treatment classes, especially if there was an agreement to attend these classes as a condition of a plea bargain or a deferred sentence of an alcohol-related offense.

Additionally, there are also situations were the court did not order a driver to complete any Alcohol Treatment classes, but Colorado law (and the DMV) states that a driver must complete Alcohol treatment classes as a condition of the driver's license reinstatement proceedings.

If you are an out of state driver and need to reinstate (your driver's license) with the State of Colorado and are required to attend and complete a Level II Drug/Alcohol Education Therapy; you must have an evaluation done by an Alcohol Treatment Center or alcohol therapist in the state where you reside.

You cannot reinstate with the State of Colorado until you can provide documentation that you have met the requirements of the center or therapist. The evaluation should be written on a letterhead from the Alcohol Treatment Center or therapist and must specify the beginning and ending dates as well as the hours that were required to fulfill this program.

How do I know if I am required to get an Ignition Interlock Device and where do I start?

You will be required to get an IID if your:

  • License has been revoked because you were convicted for two (2) alcohol related driving offenses within five (5) years

  • License has been revoked because you were convicted of three (3) alcohol related driving offenses in your driving lifetime

  • License has been revoked because you have been designated a Habitual Traffic Offender and you have at least one conviction that was alcohol related

  • Last offense occurred after 07/01/2000

  • BAC level was 0.17% or more at the time of the police stop (for all stops after 01/01/2007)

If you are a driver that falls into this category, according to the Colorado DMV, you will only be allowed to reinstate your driving privileges with a restricted license. This restriction will only allow you to drive motor vehicles enabled with an approved Ignition Interlock Device. You will also be responsible for paying all of the costs associated with an IID.

What are the minimum liability requirements for SR22 Insurance in Colorado?

The minimum Liability limits in Colorado are:

  • $25,000 per person for bodily injury

  • $50,000 per accident for bodily injury

  • $15,000 per accident for property damage

What if I fail to maintain my SR22 Insurance policy consecutively for the required period?

Many things can happen. First your license will be immediately suspended for not complying with the DMV’s requirements of a SR22, because by law the issuing insurance company has to report to the DMV any lapses in your SR22 insurance coverage. Subsequently you could incur more fines and reinstatement fees, and you could be sentenced to a jail term. If you were involved in an accident during this lapse in coverage you could be financially responsible for all injuries, if deemed your fault, you will certainly be heavily fined, be required to start the SR22 required period over from the beginning, and there is a possibility of additional charges being brought upon you.

We have a strong recommendation of paying your SR22 insurance premium 2-3 months in advance to avoid any of these situations. If 2-3 months in advance is not possible please pay at least a month in advance.
