In Florida the minimum period for SR22 Insurance is three (3) years, but there are some crimes that will require a driver to carry this policy for a longer period. In addition to having an extended SR22 insurance period, some drivers may be required to complete alcohol or drug rehabilitation classes, and/or have an IID installed in their vehicle.

What are the minimum liability insurance requirements in Florida?

For most residents of Florida the minimum liability insurance requirements are:

  • $10,000 of Personal Injury Protection

  • $10,000 of Property Damage Protection

  • $10,000 per person and $20,000 per accident for Bodily Injury Liability

DUI related offenses have had a substantial increase in the minimum liability insurance requirements that were effective October 1. 2007. This information is best understood by quoting it directly from Florida’s DHSMV website, it is as follows:

“Effective October 1, 2007, s. 324.023 Florida Statutes, requires proof of increased financial responsibility in the form of liability insurance for bodily injury or death, in those circumstances where a person has been convicted for driving under the influence. This section pertains to operators found guilty, or who enters a plea of guilty or nolo contendere (no contest) to a charge of driving under the influence under s. 316.193, F.S., after October 1, 2007. The increased requirements of liability insurance upon conviction of a DUI will be in the amount of $100,000, because of bodily injury to, or death of any one person, $300,000 for similar liability for two or more persons in any one crash and in the amount of $50,000 because of property damage liability in any one crash, or combined single limits of $350,000 to the extent of the above limits.” (Source: Dept. of Highway Safety and Motor Vehicles)

Effective February 2, 2008 drivers will be required to submit verification that reflect the higher liability limits by submitting form FR-44 from their insurance provider.

“If the customer had the required liability limits at the time of the alcohol related offense no fee will be required. If they did not have the required limits a customer who reinstates prior to February 2, 2008, will only pay a $15.00 reinstatement fee. The reinstatement fee on or after February 2, 2008, will be a fee of $150, $250, or $500 dollars.” (Source: Dept. of Highway Safety and Motor Vehicles)

What happens if I fail to keep my Florida SR22 insurance current?

For drivers that do not maintain their SR22 insurance policy, the penalties may include a license suspension along with the vehicle’s tags and registration being suspended for a period of up to three years.

SR22 Insurance policy providers are required by law to report any lapse in coverage to the Motor Vehicle Department immediately. Driver’s that are required to carry an SR22 policy you may be subject to the above actions, as well as having to restart the required SR22 insurance period from the beginning and you may also incur more expenses from additional fees associated with failing to carry and maintain an SR22 insurance policy.

Considering the complexity of some of these offenses and the suspension laws that follow, it is best to visit Florida’s HSMV Department to review these laws without misinterpretation.

How do I attend traffic school to avoid points counting against my license?

First of all, you may only go to traffic school 5 times in a 10-year period to avoid points being charged against your license. To take advantage of this option, notify the county clerk where you received the ticket (citation) that you would like to attend traffic school at the time of paying for the fine. You will not be able to attend traffic court if you change your mind after you pay the fine.

How do I reinstate my Florida driver’s license after a suspension or revocation?

Does Florida have a hardship license?

Possibly yes, for first time offenders convicted of a DUI offense. We say possibly because their may be other circumstances that do not allow a hardship license to be issued.

Florida does not have a hardship license for drivers convicted of a 2nd or subsequent suspension for a test refusal or if a driver has been convicted of a DUI more than twice.(Section 316.193, FS)

What is Florida’s Ignition Interlock Device program?

This program affects those that have been convicted of a DUI offense and as a condition of driver’s license reinstatement need an IID installed in their vehicle to fulfill that requirement.

The minimum required time period to have an IID installed and maintained in a vehicle can be from 6 months to 2-years depending on the specifics of the crime.

The cost of an IID to the accused can include:

  • $12 Interlock fee

  • $70 for installation

  • $67.50 for maintenance (monitoring and calibration)

  • $100 refundable deposit or a monthly charge of $5
