In Iowa the Motor Vehicle Department (MVD) has the ability to suspend, cancel, or revoke a driver's license if a driver is convicted of certain crimes. Additionally those crimes may require a driver to obtain and maintain an SR22 Insurance policy for the minimum period of three (3) years. Such crimes include but are not limited to:
- Operating a Vehicle While Under the Influence (OWI) of alcohol and/or drugs
- Driving a motor vehicle without insurance
- Habitual traffic offenses in a certain time period
- Operating a motor vehicle without a license
- Operating a motor vehicle on a suspended, revoked, or canceled license

What happens at an Iowa administrative hearing?
You generally only have 7 -10 days from the time of an arrest to request an administrative hearing.
Once you have officially requested an administrative hearing and have a confirmed hearing date you should try to gather as much evidence in your favor and subpoena any witnesses you may want to have at your administrative hearing
Important: You will need to subpoena any witnesses you may have in your favor prior to an administrative hearing . This cannot be done once you get to your administrative hearing..
This is a good time to contact an attorney in your area to discuss the charges and the actions being taken against you and the choices that you may have. Many attorneys have a free initial consultation and we strongly recommend that you take advantage of that offer.
Typically what happens at an administrative hearing is that all parties involved will be sworn in by the Administrative Hearing Judge and then the hearing will begin. The Administrative Hearing Judge usually starts by taking testimony from the Police Officer on the evidence that he or she has against you, as well as deciding if proper Police procedures were conducted during the traffic stop.
Once the Police Officer's testimony is completed, you and your attorney (if you hired one) will have the opportunity to rebut the evidence the Officer has against you and present any witnesses that you may have in your favor.
After all the evidence and testimonies have been presented the administrative hearing will come to a close and the Administrative Hearing Judge will make a decision on whether to enforce the action(s) against you or suspend it.
The Administrative Hearing Judge notifies the offender of their decision usually by mail. This notification varies from state to state, so please ask your attorney or the Administrative Hearing Judge on how this notification is sent and how long it will take.

What is Iowa's Ignition Interlock Device Program?
By definition: Ignition Interlock Devices (IID's) are a type of electronic breathalyzer that is installed in a vehicle that will require the driver to provide a breath sample prior to the vehicle starting and at intervals while driving. If the breath sample given is below a present level the vehicle will start. If the provided breath sample is above the preset level the vehicle will not start and if anytime while driving the breath sample provided is over the preset limit the vehicle will cease to operate.

What are Iowa's minimum liability requirements?
- $20,000 coverage for bodily injury to or death of one (1) person in any one (1) accident
- $40,000 coverage for bodily injury to or death of two (2) or more persons in any one (1) accident
- $15,000 coverage for an injury to or destruction of property of others in any one (1) accident.
How do I renew my drivers license in Iowa?
After your suspension, revocation, or cancellation period has been served and you have completed any alcohol or drug treatment classes or driving classes that were a condition of your license reinstatement; we suggest getting a copy of your motor vehicle record to find the status of your drivers license and all of the actions that have been taken against you. Then contact an Iowa MVD near you to learn what steps are necessary to take next to get your license reinstated.
Additionally you will be required to pay a license reinstatement fee and depending on your offense you may be required to have an Ignition Interlock Device (IID) installed in your vehicle.
Important: Depending on your offense you may be required to get an SR22 Insurance policy before you can reinstate your license. Always contact an Iowa Drivers License Station before you arrive to make sure that you have all the necessary paperwork filed and filled out completely.

Does Iowa have a driver improvement program?
Yes, Iowa does have a driver improvement school. Mandatory attendance at this school occurs when a driver's record reveals convictions of three (3) countable moving violations in a 12-month period, or a driver has been convicted of speeding 25 to 29 miles over the limit.
After a driver has successfully completed this program, they may be on probation for one year. If a driver is convicted of a (1) moving violation while on probation, the Office of Driver Services may start actions to suspend that driver's license.

What if I fail to maintain my SR22 insurance policy?
Your insurance provider is required by law to notify the Iowa DMV immediately when a lapse in an SR22 insurance policy has occurred. This can result in an immediate driver's license suspension, revocation, or cancellation, and you may have be subject to:
- Additional and higher fees (a lapse in coverage is considered a new offense)
- Possible jail sentence
- A longer SR22 filing period than the state minimum of three (3) years, and you may be required to start the SR22 period from the beginning again.
These are only examples of what has happened to other drivers when they failed to maintain their SR22 policy. If you fail to maintain your SR22 policy you may be subject to completely different actions being taken against you.
We strongly suggest that you avoid any lapse in coverage, it is just not worth the risk and the extra penalties associated with it!
How do I avoid a lapse in my coverage?
You can avoid a lot of additional hassles by paying your SR22 policy premium 2-3 months in advance, or at the minimum 2 weeks in advance. The point here is to pay your SR22 policy far enough in advance to avoid any lapse in coverage, whether that is 3 months or 2 weeks find a time period that works for you and your budget.
We cannot stress this enough do not let your SR22 insurance policy lapse for any reason. Call your insurance provider to see if they can help if you are having problems paying your SR22 policy premium on time.
