What happens at a Kansas administrative hearing?
You typically have only 7 -10 days to request an administrative hearing.
Once you have a hearing date scheduled you should try to gather as much evidence, as you can in your favor and subpoena any witnesses you may want to have present at your administrative hearing.

Generally the procedures at an administrative hearing begins with all parties involved in the case will be sworn in and the Administrative Hearing Judge will start taking testimony, usually from the Police Officer first.

After all the evidence has been presented and the testimonies by both parties given, the administrative hearing will come to a close and the Administrative Hearing Judge will render a decision.
If the Administrative Hearing Judge rules in your favor, the charges are dropped and driving privileges are reinstated immediately. However if the Administrative Judge rules against you, your driving privileges are taken and the suspension, cancellation, or revocation period begins.

Additionally you will be required to pay a license reinstatement fee and depending on your offense you may be required to have an Ignition Interlock Device (IID) installed in your vehicle.

What if I fail to maintain my SR22 insurance policy?
By law your insurance provider is required to notify the Kansas DMV immediately when there has been a lapse in an SR22 insurance policy. Once the DMV receives a lapse in coverage notification from an insurance provider driving privileges are generally suspended prior to any future court hearings to decide what, if any, future action will be imposed. Future actions against a driver include:
- Being charged with a separate insurance violation and possibly a higher reinstatement fee
- An additional and a longer suspension, cancellation, or revocation period
- Depending on the reason for the lapse in coverage, possibly a jail sentence
- The driver having to start the SR22 period over
These are just examples of what could happen, actual penalties will vary depending on your driving history and current reasoning for the lapse in SR22 coverage.
How do I avoid a lapse in my coverage?
Pay your SR22 policy premium well in advance. 60 days in advance is suggested, however find a time period that works best for you and your budget and remember not to pay your premium late.
